Who can use FitPit
You must be at least 13 years old, or the minimum age required in your country, to use FitPit. If you are under the age of majority where you live, you need a parent or guardian's permission. You are responsible for your account and for keeping access to it secure.
Your health comes first
FitPit is a fitness game, not medical advice. Exercise carries a risk of injury. Talk to a doctor before starting if you have a health condition, are pregnant, or are unsure whether an exercise is safe for you. Stop immediately if you feel pain, dizziness or shortness of breath.
Train in a safe space with room to move, and place your phone where it cannot fall. Rep counts, scores and form feedback are estimates made by software and may be wrong. You use FitPit at your own risk, to the extent the law allows.
Community rules — zero tolerance
FitPit has no tolerance for objectionable content or abusive users. You must not post, upload or use as a username, picture, community name or description anything that:
- harasses, bullies, threatens or intimidates anyone;
- is hateful or discriminatory, or promotes violence, on the basis of race, ethnicity, religion, disability, sex, gender identity, sexual orientation, age or any other characteristic;
- is sexually explicit, pornographic, or sexualises minors in any way;
- impersonates FitPit, a real person or an organisation;
- is spam, a scam, or promotes illegal activity or self-harm;
- infringes someone else's rights, including copyright and trademarks.
You also must not cheat: fake or manipulate sets, use another person or a device to perform reps for you, exploit bugs, automate the app, or interfere with other users or our systems.
You can report any user or community from their page, and block any user. We review every report within 24 hours. When content breaks these rules we remove it, and we may suspend or permanently ban the account responsible without notice.
Your content
You keep ownership of the content you create, such as your username, pictures and community details. You give FitPit a worldwide, non-exclusive, royalty-free licence to host, store, display and adapt it as needed to operate and promote the app, for as long as it is on FitPit. You are responsible for having the rights to what you upload.
Competition, scores and rankings
Scores, XP, levels, streaks, divisions and rankings are part of the game. They have no cash value, cannot be transferred, and may be recalculated, corrected or reset — for example after a set fails verification, after cheating is detected, or when scoring rules change. Daily limits apply to what counts towards rankings.
Communities and creators
Community owners are responsible for their community's name, picture, description and challenges, and must follow these terms. We may edit, reset or remove any community that breaks them. Creators who take part in a FitPit creator programme are bound by the separate terms of that programme.
Subscriptions
Some features may require a paid FitPit Pro subscription. Subscriptions are purchased through your Apple ID and renew automatically until cancelled. Payment is charged to your Apple ID at confirmation of purchase. You can manage or cancel a subscription in your Apple ID settings at least 24 hours before the end of the current period. Refunds are handled by Apple under its policies. Prices and features may change; we will tell you before a change affects a subscription you already have.
Apple
These terms are between you and FitPit, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support for it, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with Apple's Licensed Application End User License Agreement and the App Store Terms.
Ending your use
You can stop using FitPit and delete your account at any time from Settings. We may suspend or end your access if you break these terms, if required by law, or if we stop providing the app. Sections that by their nature should survive (such as your content licence for already-shared content until removed, disclaimers and limits of liability) continue after your account ends.
Disclaimers and liability
FitPit is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties that the app will be uninterrupted, error-free or accurate, and we are not liable for indirect, incidental or consequential damages, or for any injury arising from exercise you choose to do. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or EUR 50 if you paid nothing.
Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your mandatory rights as a consumer in your country.
Changes to these terms
We may update these terms. If a change is significant, we will tell you in the app before it takes effect. Continuing to use FitPit after that means you accept the new terms.
Law and disputes
These terms are governed by the laws of the Kingdom of Morocco, without affecting any mandatory consumer protection laws of the country where you live, and you may bring a claim in the courts of your country of residence where the law allows. Before starting a formal dispute, please contact us — most problems can be solved by email.
